1. About these Terms

These Terms and Conditions govern access to and use of Fidget, an online platform that helps users discover, compare, save, and track events and ticket options, including through artist favourites, personalised recommendations, optional music-service connections, and location-based discovery features.

By accessing or using Fidget, a user agrees to these Terms. If a user does not agree, that user must not use the service.

Users must be at least 18 years old, or the age of legal majority in their jurisdiction, to create an account unless the service expressly allows a younger age with appropriate consent.

A user may only use Fidget if able to form a binding contract and comply with applicable laws.

4. The service

Fidget provides tools to search events, compare listings, view pricing and availability information, save favourites, receive personalised discovery features, and access links or referrals to third-party event organisers, venues, ticketing providers, resellers, or partners.

Unless expressly stated otherwise, Fidget is not the organiser of listed events, is not the venue, and is not the merchant of record for tickets sold by third parties. A purchase made through a linked third-party site is governed by that third party's own terms, pricing, fulfilment, cancellation, refund, and customer support policies.

Some features may require account creation. Users must provide accurate, complete, and current information and keep login credentials secure.

A user is responsible for activity carried out through that user's account unless caused by Fidget's failure to apply appropriate security measures.

Users must notify Fidget promptly of suspected unauthorised access or misuse of an account.

6. Personalised features and integrations

Fidget may allow users to favourite artists, venues, or events and may use those preferences, search behaviour, location signals, and event interactions to personalise rankings, recommendations, alerts, and "For You" features.

Fidget may also offer optional integrations with services such as Spotify, Apple Music, or YouTube Music. If a user connects a third-party account, the user authorises Fidget to access and use the permitted data needed to operate the requested feature, subject to the permissions granted and the third party's terms.

Users may disconnect integrations through available settings or by contacting support, though some personalised features may then be limited.

7. Event information and availability

Fidget aims to present useful and timely event information, but event details may change at any time. Dates, times, line-ups, prices, age restrictions, venues, accessibility information, and ticket availability may be changed, withdrawn, or corrected by organisers, venues, promoters, and sellers.

Fidget does not guarantee that any listing, price, availability status, resale label, or event information is complete, accurate, or current at all times.

Users should verify key details directly with the relevant organiser or ticket seller before making plans or completing a purchase.

8. Third-party sellers and links

Fidget may display links to third-party websites, apps, sellers, organisers, maps, embedded services, and external content. Those third parties are independent from Fidget.

Fidget is not responsible for third-party websites, ticket inventory, payment handling, delivery, chargebacks, refund processing, event cancellation, postponement, venue entry policies, or any loss arising from a user's dealings with a third party, except where liability cannot lawfully be excluded.

9. Acceptable use

Users must not:

  • Use Fidget unlawfully or in a way that infringes the rights of any person.
  • Scrape, crawl, harvest, copy, or extract data from the service using automated means except where expressly authorised.
  • Interfere with security features, rate limits, access controls, recommendation systems, rankings, or platform integrity.
  • Upload or transmit malware, harmful code, or material that is defamatory, abusive, fraudulent, or misleading.
  • Impersonate another person or misrepresent an affiliation.
  • Use the service to manipulate demand, resale visibility, pricing signals, or referral tracking.
  • Attempt to gain unauthorised access to accounts, systems, or data.

10. Intellectual property

Fidget and its licensors own all intellectual property rights in the service, including the software, design, branding, selection and arrangement of content, databases where protected, rankings, graphics, and original platform materials, except for third-party materials owned by their respective rights holders.

Users receive a limited, non-exclusive, non-transferable, revocable licence to access and use Fidget for personal, non-commercial use in accordance with these Terms.

No right is granted to reproduce, distribute, modify, reverse engineer, frame, republish, sell, or exploit any part of the service except as permitted by law or with prior written permission.

11. User content

If Fidget allows users to submit content, including profile information, favourites, lists, comments, reviews, feedback, or uploads, the user remains responsible for that content.

By submitting content, the user grants Fidget a non-exclusive, worldwide, royalty-free licence to host, reproduce, adapt, display, and use that content as needed to operate, improve, promote, and secure the service, subject to the Privacy Policy where personal data is involved.

Fidget may remove content that breaches these Terms, infringes rights, creates legal risk, or harms the service.

12. Suspension and termination

Fidget may suspend, restrict, or terminate access where reasonably necessary to protect the platform, investigate misuse, respond to legal requirements, prevent harm, or address breaches of these Terms.

A user may stop using the service at any time and may request account closure where an account exists.

Any provision that by its nature should continue after termination, including provisions on liability, intellectual property, acceptable use, dispute resolution, and accrued rights, will continue to apply.

Use of the service is also governed by the Privacy Policy and Cookies Policy. Those documents explain how personal data and cookie technologies are handled in connection with Fidget.

14. Disclaimers

To the fullest extent permitted by law, Fidget is provided on an "as is" and "as available" basis. No promise is made that the service will be uninterrupted, secure, error-free, or suitable for a user's specific purpose.

Nothing in these Terms excludes any consumer rights that cannot lawfully be excluded.

15. Limitation of liability

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be limited or excluded.

Subject to the paragraph above, Fidget will not be liable for indirect or consequential loss, loss of profit, loss of business, loss of opportunity, loss of goodwill, or loss of data arising from or connected with use of the service.

Subject to applicable law, Fidget's total liability arising out of or in connection with the service will not exceed the greater of: (a) the amount paid by the user to Fidget in the 12 months before the claim arose; or (b) £100.

16. Indemnity

If a user breaches these Terms or applicable law and that breach causes a claim, loss, or expense to Fidget, the user may be responsible for losses reasonably incurred by Fidget, except to the extent the loss was caused by Fidget's own negligence or breach.

17. Changes to the service or Terms

Fidget may update, suspend, or discontinue features at any time. Fidget may also revise these Terms to reflect changes to the service, law, security, or business operations.

Where changes are material, reasonable steps should be taken to notify users, such as by posting an updated version on the site or notifying account holders.

18. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales unless mandatory local consumer law provides otherwise.

If a user is a consumer, court proceedings may be brought in the courts of England and Wales or, where required by law, in the courts of the user's home jurisdiction within the UK. If a user is acting in the course of business, the courts of England and Wales will have exclusive jurisdiction unless otherwise required by law.
